Acceptance of terms
By accessing or using Oceanova, you agree to these Terms of Service. If you do not agree, please do not use the platform.
Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract to book a charter or hold an account on Oceanova. By using the platform you confirm that you meet these requirements.
Our role
Oceanova is a booking and contact site operated by Ann Dominique Quilang, an independent yacht charter agent. It introduces guests to licensed yacht charter operators. We take no payment and operate no vessels. Bookings, payment, and the charter itself are arranged directly between you and the licensed operator.
Bookings and payments
All pricing and availability are set by the operator. Full payment must be cleared on or before the booking time, and in any case before the trip commences. Oceanova charges no booking fees to guests.
Cancellations
Charter cancellations must be made at least 72 hours before the booking date. Cancellations made less than 72 hours before the booking date will be charged the full charter amount. Operators may also cancel or postpone a charter due to weather, mechanical failure, Coastguard restrictions, or UAE law-enforcement decrees.
Charter conduct & safety
All charters are subject to our Charter Disclaimer, which forms part of these terms. Guests must follow the captain's instructions at all times, wear life jackets, respect the vessel's maximum capacity, and comply with UAE law (including rules on alcohol during Ramadan and dry days, and prohibitions on smoking and vaping on board). Please read the Disclaimer in full before booking.
Operator responsibilities
Operators are responsible for the accuracy of their listings, the legality of their operations, valid insurance, and the safety of their vessels and crew. Listings are reviewed before going live but Oceanova does not guarantee any listing.
Acceptable use
You agree not to misuse the platform, post false information, infringe others' rights, or attempt to disrupt the service. We may suspend accounts that violate these terms.
Limitation of liability
Oceanova is provided “as is.” To the maximum extent permitted by law, we are not liable for any disputes, damages, injury, or losses arising from charters arranged through the platform. Liability for the charter itself rests with the operator. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence.
Indemnity
You agree to indemnify and hold Oceanova harmless from any claims, losses, or expenses arising from your misuse of the platform, your breach of these terms, or your conduct during a charter.
Intellectual property
The Oceanova name, logo, site design, and content are owned by Oceanova or its licensors and may not be copied or reused without permission. Listing content remains the responsibility of the operator who submitted it.
Account termination
We may suspend or terminate accounts that violate these terms, provide false information, or misuse the platform, at our discretion and without prior notice where necessary.
Severability & entire agreement
If any provision of these terms is found unenforceable, the remaining provisions continue in effect. These terms, together with our Privacy Policy, Cookie Policy, and Charter Disclaimer, form the entire agreement between you and Oceanova. A failure to enforce any provision is not a waiver of it.
Governing law
These terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. Any dispute shall be subject to the exclusive jurisdiction of the courts of Dubai.
Changes to these terms
We may update these terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.
